Limited license: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include any right to resell or commercially use the Site or its content; collect or use any product listings, descriptions, or prices; make any derivative use of the Site; or use any data mining, robots, or similar tools.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law.

You agree to indemnify, defend, and hold harmless GROUP BRITOX LIMITED and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of any law or third-party right, including any intellectual property right, privacy right, or publicity right.

  • Any User Content you submit.

15. Termination

We shall not be liable for any failure or delay in performance under these Terms that is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, labor disputes, or shortages of transportation facilities, fuel, energy, labor, or materials.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Any dispute, controversy, or claim arising from or relating to these Terms, the Site, or any product (a “Dispute”) shall first be addressed by good-faith negotiation between the parties. The party raising the Dispute shall send written notice to the other party describing the issue. If the Dispute is not resolved within thirty (30) days of such notice, it shall be submitted to the exclusive jurisdiction of the competent courts of Hong Kong, except that we reserve the right to seek injunctive or equitable relief in any court of competent jurisdiction.

Nothing in this section limits any non-waivable consumer rights you may have under the mandatory laws of your country or state of residence.
